Terms of service
These terms and conditions (the "Terms") are applicable to the utilization of the web application referred to as BakeShop (the "Application"), operated by Mihiri (Pvt) Ltd., located at 61, Mahavidyala Mawatha, Colombo 13, Sri Lanka, ID: P.V. 0011410 (referred to as the "Company"). By accessing and using the Application, you signify your agreement to abide by these Terms. Should you not agree with these Terms, you must refrain from using the Application.
Use of the Application
You are permitted to employ the Application for the purpose of procuring vouchers related to accommodations, food, experiences, and other activities and goods made available through our services. However, the Application must not be used:
- In any manner that violates any applicable local, national, or international laws or regulations.
- In any manner that is unlawful, fraudulent, or for any unlawful or fraudulent purposes.
- To transmit, knowingly receive, upload, download, use, or re-use any material that does not adhere to our content standards.
- To transmit or solicit unsolicited or unauthorized advertising, promotional materials, or any form of solicitation akin to spam.
- To knowingly transmit any data, send, or upload material containing viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other malicious programs or computer code intended to adversely affect the operation of computer software or hardware.
Intellectual Property Rights
The Application and its contents, encompassing but not limited to text, graphics, images, logos, button icons, software, and the compilation of content, are the exclusive property of the Company and are protected by both Sri Lankan and international copyright and trademark laws. Commercial usage of any of the Application's content requires prior licensing from the Company or its licensors.
Modifications to printed or digitally downloaded materials are strictly prohibited, as is the utilization of illustrations, photographs, videos, audio sequences, or graphics without their accompanying text.
Application Availability
The Company does not guarantee continuous availability or uninterrupted access to the Application or its content. Access to the Application is granted on a temporary basis, and the Company retains the right to suspend, withdraw, discontinue, or alter any part of the Application without prior notice. The Company holds no liability to you if, for any reason, the Application becomes unavailable at any time or for any duration.
You are responsible for making the necessary arrangements to ensure access to the Application and for ensuring that all individuals who access the Application through your internet connection are familiar with and adhere to these Terms and other relevant terms and conditions.
Limitation of Liability
The Company does not exclude or limit its liability for:
- Fraud or fraudulent misrepresentation.
- Any other liability that cannot be excluded or limited under Sri Lankan law.
The Company shall not be held liable for any loss or damage, whether contractual, tortious (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising in connection with:
- Use of, or inability to use, the Application.
- Reliance on any content displayed on the Application.
- Any loss of profits.
The Company explicitly acknowledges that it assumes no responsibility or liability for injuries, fatalities, health issues, or any other damages that may arise from the utilization of products/services or participation in events/activities facilitated by the Company. The sole responsibility for such matters lies with the partnering organizations directly responsible for delivering the value of the product/service.
In cases where injuries, fatalities, health problems, or other damages are attributable to the products/services or events/activities mediated by the Company, the Company's liability is limited to issuing refunds for the mediated product/service value. Legal claims, actions, or proceedings stemming from such matters are to be directed towards and resolved between the affected party and the partnering organization. The Company's liability, in such instances, is confined to the issuance of refunds and does not extend to any other form of compensation, remedy, or responsibility.
The Company and partnering organizations operate in a collaborative partnership, and the Company takes all reasonable measures to ensure the quality of products/services and events/activities facilitated through its mediation. Any issues concerning the quality of the products/services or events/activities are the sole responsibility of the partnering organization, and the Company is not liable for any resulting consequences.
